Gainesville attorney filed emergency petition challenging mask mandates, Alachua County Public Schools must respond by Friday

A Gainesville attorney is taking aim at Alachua County Public Schools’ mask mandate.

Jeff Childers of Childers Law, LLC, filed an emergency petition on behalf of parents with the 1st District Court of Appeal. The school board must respond by Friday, Oct. 8.

The petition, which was filed on Friday, Sept. 30, asks the appeals court to charge the school board to abide by the state’s updated emergency rule, which states the school board must include a non-medical option for students to opt out of wearing a mask.

In August, Childers also represented more than 200 Gainesville city employees in a lawsuit challenging the constitutionality of mandatory vaccinations. In September, Alachua County Civil Circuit Judge Monica Brasington heard the case and granted temporary injunction, preventing the city from enforcing mandatory vaccination for employees by Oct. 31.
